Terms of service

These Terms of Service ("Terms") govern your use of the CalmClaws website at getcalmclaws.com (the "Site") and your purchase of products from it. By using the Site or placing an order, you agree to these Terms.("CalmClaws", "we", "us").

1. Ordering and acceptance

All orders placed through the Site are offers to purchase. We may accept or decline any order, including for suspected fraud, pricing or stock errors, or shipping restrictions. An order is accepted when we send dispatch confirmation. If we cancel an order before dispatch, you receive a full refund.

2. Pricing and payment

Prices are shown in US dollars unless stated otherwise and may change at any time without notice. Price changes don't affect orders already placed. If a product is listed at an obviously incorrect price due to an error, we may cancel the order and refund you. Payment is processed at checkout by our third-party payment providers; we don't store your full card details.

3. Shipping and delivery

Delivery estimates shown at checkout and on product pages (typically 7 to 12 days for US orders) are good-faith estimates, not guarantees. Carrier delays, customs processing, and events outside our control can extend delivery times. Risk in the products passes to you on delivery. Our lost-parcel policy is set out in the Refund & Return Policy, which forms part of these Terms.

4. Product use and safety

CalmClaws products are enrichment and grooming tools for dogs and must be used under adult supervision. Follow the included guide. The board files front nails through your dog's own scratching; it is not a substitute for veterinary care, and nothing on this Site is veterinary advice. If your dog has a paw injury, cracked or damaged nails, or a health condition affecting their feet or movement, consult your vet before use. Stop use if your dog shows signs of paw irritation. Keep refill sheets and packaging away from dogs when not in supervised use; components can present a chewing hazard to determined chewers.

5. Subscriptions

Refill auto-ship subscriptions renew automatically at the interval shown at signup until cancelled. The renewal price is the price stated at signup unless we notify you of a change before your next renewal. You can pause, skip, or cancel anytime up to 24 hours before a renewal via your account or by emailing us. By subscribing you authorise recurring charges to your payment method.

6. Guarantee and refunds

Our 90-Day Calm-Dog Guarantee and all refund terms are set out in the Refund & Return Policy, which forms part of these Terms. To the extent permitted by law, the guarantee is your exclusive remedy for a product that works as designed but doesn't suit your dog. Nothing in these Terms excludes rights you have under applicable consumer protection laws that cannot be excluded, including the Australian Consumer Law and applicable US state consumer laws.

7. Reviews, photos, and submissions

If you send us or tag us in photos, videos, reviews, or messages about your dog and your CalmClaws products, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing, including on the Site, ads, and social media, with or without your handle. Tell us anytime at getcalmclaws@gmail.com if you'd like content featuring you removed and we'll take it down from channels we control.

8. Intellectual property

All content on the Site, including the CalmClaws name, wordmark, product design, the Calm Nails Method guide, copy, and images, is owned by or licensed to us. You may not copy, resell, or commercially use any of it without written permission. The guide is licensed for your personal use only.

9. Acceptable use

You agree not to misuse the Site, including attempting to breach its security, scraping its content at scale, placing fraudulent orders, or abusing discount codes or the guarantee. We may refuse service, cancel orders, or close accounts for misuse.

10. Disclaimers and limitation of liability

The Site and products are provided "as is" to the maximum extent permitted by law. To the maximum extent permitted by law: (a) we exclude all implied warranties not required by statute; (b) our total liability for any claim relating to a product or the Site is limited to the amount you paid for the relevant order; and (c) we are not liable for indirect, incidental, or consequential losses. Nothing in these Terms limits liability that cannot be limited by law, including under the Australian Consumer Law, or your statutory rights as a consumer in your place of residence.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of [New South Wales / your state], Australia, and you submit to the non-exclusive jurisdiction of its courts, except where the consumer protection laws of your place of residence grant you non-waivable rights or forums. Before any formal dispute, you agree to contact us first at getcalmclaws@gmail.com so we can try to resolve it, which is genuinely what we prefer.

13. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time you place an order applies to that order.
